Suffolk County Passes Salary History Ban

On November 30, the Suffolk County Legislature passed a salary history ban. The new law amends the County’s Human Rights legislation and takes effect June 30, 2019.
 
Under the law, employers with four (4) or more employees are prohibited from:
  • Inquiring into an applicant’s wage or salary history information including compensation and benefits. This includes asking an applicant or former employer orally or in writing, or conducting a search of publicly available records.
  • Relying on salary history information to determine the wage or salary amount for an applicant at any stage in the process including the offer.
The law does not apply to employers who are required by local, state or federal law to obtain or verify salary information for employment purposes.
