New Mexico Enacts Medical Psilocybin Act

New Mexico recently passed Senate Bill 219, the Medical Psilocybin Act, which is now in effect.

According to the New Mexico Department of Health, the “legislation establishes a regulated program for the medical use of psilocybin, a naturally occurring psychedelic compound, to treat qualified medical conditions such as major treatment-resistant depression, PTSD, substance use disorders, and end-of-life care.”

The Department expects the program to be fully implemented by December 31, 2027. The Department is now working on developing the rules and regulations that will govern the program. At this time, there are no requirements for employers to accommodate psilocybin use while at work.

Employers should continue to track any new rules and regulations the New Mexico Department of Health may release to determine if any changes to their drug testing or workplace drug policies may be required in the future.
